Acceptable Use Policy

Handraise is a trading name of AJBERRI PTY LIMITED (ABN 15 146 964 203). This Acceptable Use Policy sets out the rules for using Handraise. It forms part of the Terms of Service. The rules exist for one reason: Handraise is built so that outreach in Australia is done lawfully and honestly, and that only works if everyone using it holds the line.
Handraise produces work - videos, matched leads, cited research, and verified business contact results - that lands in your dashboard. You deliver any outreach through your own channels, so you are the sender, and these rules govern how you use what Handraise gives you.

1. Prohibited data sources
You must not use Handraise with contacts from banned sources. Specifically, you must not:
- Import, upload, buy, or rent contact lists. You may use prospects identified through Handraise or contacts you have compiled lawfully from published business information.
- Use guessed or inferred contact values. Contact information must be explicitly published by an approved source and, where the tool requires it, verified before it is returned.
- Use consumer or sensitive personal information. Handraise is for relevant business-to-business research and outreach.
2. A lawful basis for every contact
Every prospect you contact using Handraise output must have a lawful basis for being contacted. You must be able to show that:
- the contact's information was legitimately obtained from a public business register or published business information, and
- contacting them for the purpose you intend is lawful under the Spam Act 2003 and any other applicable law.
3. Honest sender identification
Because you deliver outreach yourself, you are the sender under the Spam Act 2003. You must not:
- Misrepresent who a message is from.
- Use a misleading "from" name, sender address, or reply-to address.
- Omit your business identity from a message.
- Do anything that could reasonably deceive a recipient about who is contacting them or why.
Every commercial message you send must accurately identify your business.
4. Australian targeting by default
Handraise targets Australian businesses by default. Targeting prospects outside Australia requires deliberate action, and if you do it, you are solely responsible for complying with the laws of the destination country.
5. Unsubscribe and suppression
Every commercial message you send must include a functional way to unsubscribe. You must:
- Honour unsubscribe and opt-out requests immediately.
- Never re-add an unsubscribed contact to your outreach.
- Never penalise, mislead, or make it hard for someone to opt out.
Handraise does not send messages or manage unsubscribes for you. You are responsible for recording and applying opt-outs in every channel you use.
6. Responsible delivery
You deliver outreach through your own accounts, so you are responsible for the volume, cadence, and sending reputation of those accounts. You must:
- Keep your sending within the limits and terms of your own email or messaging providers.
- Not use Handraise output to send at volumes or in a manner that would breach the Spam Act 2003 or amount to spam.
- Not use Handraise to send content that is unlawful, misleading, harassing, or harmful, or that infringes someone else's rights.
7. Protecting the platform
You must not:
- Attempt to export, copy, or resell the underlying business database or any bulk contact data.
- Circumvent source, targeting, audit, or credit controls.
- Interfere with the security or operation of Handraise, or access it in a way you are not authorised to.
8. How we enforce this
If we reasonably believe you have broken this policy, we may:
- Suspend your account.
- Terminate your subscription, without a refund for the current period.
- Refer the matter to the relevant authorities where the law requires it.
Except where immediate action is needed to prevent ongoing harm, we will tell you about a suspected breach and give you a chance to respond before we act.
9. Your indemnity
You agree to indemnify AJBERRI PTY LIMITED against any loss, damage, claim, or expense arising from your breach of this Acceptable Use Policy or from outreach you deliver, to the extent it is not caused by us.
